If D.CREATIVES is unable to perform this agreement, in whole or in part, due to fire, natural disasters, acts of God, terrorism, government restrictions, illness, injury, or any other cause beyond the control of the parties, D.CREATIVES will make a reasonable effort to secure a replacement professional photographer or videographer to fulfill the obligations. If no replacement can be secured, D.CREATIVES shall return 50% of the total amount paid to the Client and shall have no further liability under this Agreement. This limitation of liability shall also apply in cases where photographic or video materials are damaged during processing, lost due to camera malfunction, lost in transit, or require reshooting. In all such cases, liability is strictly limited to the amount paid under this contract.

The Client acknowledges that they are paying for the photography and videography services and final deliverables, and therefore, ownership and usage rights to the final materials shall belong to the Client. However, D.CREATIVES retains the right to use selected photos or videos, whether final or sample, for portfolio, marketing, or promotional purposes only with the prior written consent of the Client. This includes, but is not limited to, use on websites, social media platforms, printed materials, and advertisements. The Client has the right to decline or limit such usage in writing.

It is understood and agreed that D.CREATIVES shall be the sole professional photography and videography service provider for the event. The Client agrees that no other professional photographers or videographers shall be allowed to capture photos or videos during the event without the prior written consent of D.CREATIVES.

Upon signing this agreement by both parties, all deposits are strictly non-refundable, regardless of any changes to the event date or cancellation of the event for any reason, including but not limited to personal reasons, medical emergencies, weather conditions, or force majeure circumstances. The deposit serves as a retainer fee to reserve the event date and is not transferable to another event or date unless otherwise agreed in writing by D.CREATIVES.

If D.CREATIVES is unable to perform its agreement in whole or in part due to fire, natural disasters, acts of God, acts of terrorism, illness, injury, or any other cause beyond control, the company will make reasonable efforts to secure a replacement professional photographer or videographer but is not liable for consequential damages.
